When you place an order with us, you're entering into our Terms of Service – our mutual agreement that outlines how we'll work together. This covers everything from how we process your order to what you can expect from our team, your responsibilities as our customer, and your rights under Australian consumer law. We've designed these terms to be fair and transparent, ensuring both you and Studio Emaree are protected throughout your shopping experience.
Your order becomes legally binding when we send you a confirmation email. Until then, it's not quite official yet. We do reserve the right to cancel orders in rare circumstances – things like unexpected stock issues, pricing errors, or if our security systems flag something suspicious. If we ever need to cancel your order, we'll contact you immediately and provide a full refund. We hate disappointing our customers, so this rarely happens.
Contact our team at support@studioemaree.com as soon as you notice the mistake. If your order hasn't entered our production process or been dispatched, we'll do our best to make the changes you need. However, once our studio has started handcrafting your piece, especially for custom or made-to-order items, changes become much more difficult or sometimes impossible. The sooner you reach out, the better chance we have of helping you.
Yes, our made-to-order and custom pieces are handcrafted specifically for you in our studio. Because each piece is created with you in mind, these items are generally not refundable unless they arrive faulty or we've made an error. It's similar to commissioning a piece of art – once it's made for you, it's uniquely yours. You can find all the details about this in our Returns Policy, but we're always happy to discuss any concerns before you order.
Your security is very important to us. We use encrypted checkout systems and trusted payment gateways like Shopify Payments to ensure your information is completely safe. We never store your card details on our servers – once your payment is processed, those details are removed from our system entirely. We take data protection seriously and follow strict security protocols to keep your personal information secure.
We would never cancel your order without letting you know immediately. While we rarely need to cancel orders, we do reserve the right to do so in exceptional circumstances – things like significant pricing errors on our website, security concerns, or if an item becomes unexpectedly unavailable. If this ever happens, you'll be the first to know, and we'll provide a full refund straight away.

We only use your data to provide you with the best possible service – processing your orders, sending you updates, and occasionally sharing news about new collections if you've opted in. These Terms of Service (“Terms”) govern your use of the Studio Emaree website and services. By placing an order or interacting with our platform, you agree to be bound by these Terms. 1) Eligibility and User Conduct
To use our services, you must be at least 16 years old. If under 18, you must have parental or guardian consent.
You agree not to:

2) Contract Formation
A legally binding contract forms when:
- You place an order through our website
- We accept the order and send a confirmation email
We may refuse or cancel an order for reasons including product availability, payment issues, suspected fraud, or pricing errors. You will receive a full refund for any cancelled paid order.
3) Product Listings and Availability
We take care to ensure our product listings are accurate, but:
- Small variations may occur, especially for handmade items
- We reserve the right to modify or discontinue products without notice
Product types include made-to-order, ready-to-ship, and pre-order items, as noted on product pages.
4) Pricing and Payment
All prices are in AUD and include GST where applicable.
We accept secure payments through:
- Shopify Payments (Visa, Mastercard, etc.)
- Approved third-party gateways
All transactions are encrypted and PCI DSS-compliant. We do not store your credit card information.
5) Shipping and Fulfilment
Orders are dispatched in accordance with our Shipping Policy.
- Made-to-order items: 2–4 weeks
- Ready-to-ship items: 1–3 business days
- Pre-orders: As stated per product
Customers are responsible for ensuring accurate delivery information. Tracking is provided via email once an order is shipped.
6) Cancellations and Changes
If you need to cancel or change an order, contact us immediately. We cannot guarantee changes after an order has entered production or been dispatched.
Custom and made-to-order items cannot be cancelled once work has begun.
7) Returns, Refunds, and Consumer Rights
Your rights under the Australian Consumer Law (ACL) remain fully protected. You are entitled to a remedy if a product:
- Is faulty or unsafe
- Is significantly different from the description
- Does not perform as expected
We do not accept returns for change of mind or incorrect selections, especially for custom or sale items. See our Returns Policy for full guidance.
8) Gift Cards and Store Credit
Gift cards are non-refundable and valid for 12 months unless stated otherwise. Store credit is issued at our discretion and cannot be exchanged for cash.
9) Intellectual Property
All site content — including product images, text, branding, and design — is owned by Emaree or licensed to us. You may not copy or reuse this content without written permission.
10) Privacy and Security
Your data is handled in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
We take your privacy seriously and only collect, use, or share data as necessary to operate our business and fulfil your orders securely.
11) Force Majeure
We are not liable for delays or failures caused by circumstances beyond our control, including but not limited to:
- Postal disruptions
- Natural disasters
- Supply shortages
- Pandemics or lockdowns
- Internet or infrastructure outages
12) Limitation of Liability
To the extent permitted by law:
- Our liability is limited to the cost of the affected product or service
- We are not responsible for indirect or consequential damages
Nothing in these Terms limits your rights under the ACL.
